The rules that apply when you use Getprop, whether you're buying, selling or partnering with us as an agency.
Getprop is a private introduction and verification service. We introduce prospective buyers to prospective sellers of immovable property, and to registered property practitioners. We are not an estate agency, we do not hold mandates, and we do not act as agent for either party.
We carry out reasonable checks on identity, ownership, mandate and affordability before making an introduction, and we record what was checked. Those checks are based on the documents and information given to us and on public records available at the time. They are a substantial reduction of risk, not a guarantee. You remain responsible for your own due diligence and for appointing your own attorney before you sign anything.
You must give us accurate and complete information, and tell us promptly if it changes. Giving false information about ownership, identity or financing is grounds for immediate removal from our records, and where appropriate we will report it.
Buyers are never charged by Getprop. Sellers and partner agencies pay an introduction fee that is agreed in writing before any introduction is made, and that becomes payable only on registration of transfer. No fee is payable for a listing, for verification, or for an introduction that does not result in a sale.
Where Getprop has introduced a buyer and a seller, and that introduction leads to a sale within 12 months, the agreed fee is payable even if the parties conclude the transaction through another channel. The introduction record is the evidence of the introduction.
Partner agencies warrant that they are registered with the Property Practitioners Regulatory Authority and hold a valid Fidelity Fund Certificate for the duration of the partnership, and must notify us immediately if either lapses. We may suspend a partnership without notice if it does.
All purchase funds must be paid into the trust account of the conveyancing attorney appointed for the transaction. Always confirm banking details telephonically with the firm, using a number you obtained independently. Getprop will never request payment of a deposit or purchase price.
Getprop is not a party to any sale agreement between a buyer and a seller and is not liable for the performance of either party, the condition of any property, or the outcome of any transaction. To the extent permitted by law, our liability arising from our services is limited to the fees actually received by us in connection with the relevant introduction. Nothing in these terms limits liability for fraud or gross negligence, or affects your rights under the Consumer Protection Act.

These terms are governed by the law of the Republic of South Africa, and the courts of the Western Cape have jurisdiction. This is a general framework and not legal advice — have an attorney review these terms against your final commercial arrangements before you rely on them.
